WIP Concept-Store

Our general terms and conditions of sale have been developed from a free and open-source template that can be downloaded from https://www.donneespersonnelles.fr/.

The WIP Concept-Store online shop sells Products from various designer brands, exclusively to consumers. Products are sold via the Website.

These GTC govern the use of the website www.wipconceptstore.com, published by the company MEET JAKY, a simplified joint-stock company (SAS) with a share capital of 1,000 euros, with its registered office at 81 rue de l'Amiral Roussin, 75015 Paris, registered with the Paris Trade and Companies Register under number 883 650 863 (SIRET: 883 650 863 00029), represented by Ms. Jaky SAINSILY, as President, duly authorized for these purposes.

WIP Concept-Store can be reached by email by clicking on the contact form accessible via the Website's homepage or at the following address: wipconceptstore@gmail.com, or by phone at 07 66 21 33 31.

Article 1: Definitions

In the context of these GTC, the following definitions shall apply to all terms beginning with a capital letter, in both singular and plural:

“Customer”: the consumer, client of WIP Concept-Store on the Website.

“Order”, “Ordering” or “To Order”: the process of ordering one or more Product(s) by the Customer from WIP Concept-Store on the Website.

“Account”: the Customer's account, allowing them to Order on the Website, accessible by their username and password, and containing their personal information and history.

“General Terms” or “GTC”: this document.

“Personal Data”: personal data collected and processed by WIP Concept-Store.

“Party”: WIP Concept-Store and/or the Customer, taken individually and/or collectively.

“Privacy Policy”: WIP Concept-Store's privacy policy, accessible on the Website.

“Product”: the product(s) sold by WIP Concept-Store on the Website. This may include ready-to-wear items, accessories, bags, shoes, hats, jewelry, as well as cosmetics and decorative objects.

“Showroom”: the physical presentation and collection space located in Guadeloupe, whose contact details are provided in Article 9 bis hereof.

“Website”: the website www.wipconceptstore.com, its components, as well as any other support for the site, such as a mobile application.

Article 2: Purpose

These GTC define the conditions under which WIP Concept-Store will sell its Products to Customers on the Website.

Article 3: Rules governing the GTC

The Customer undertakes to read these GTC carefully before using the Website. The Customer must be a major natural person and have legal capacity in their country of residence.

If WIP Concept-Store is informed that a Customer does not comply with the terms previously indicated, WIP Concept-Store may delete their Account and cancel any Order, without notice and without incurring liability.

WIP Concept-Store reserves the right to modify the GTC at any time, by notifying the Customer by email or by notification upon their next login to the Website. In the absence of acceptance of the modified GTC by the Customer, WIP Concept-Store may delete the Account. The Customer may also delete their Account.

In order to place an Order on the Website, the Customer must read and accept these GTC. This acceptance will be expressed by checking the box corresponding to the acceptance phrase of these GTC during registration on the Website, for example with the mention "I acknowledge having read and accepted all of the GTC" or another equivalent mention.

The GTC applicable to the use of the Website are those in force on that date, and the GTC applicable to the Order of Products are those accepted by the Customer during the Order.

Article 4: Account

4.1. General

In order to Order on the Website, the Customer must create an Account. They will create a username and password. They must ensure that the password is strong and secure enough. WIP Concept-Store will not be responsible in case of access to the Account by a third party, by a brute force attack.

4.2. Use of the Account

The Customer is responsible for the security and use of their Account's username and password. The Customer must ensure that they are used in accordance with these GTC. WIP Concept-Store will not be responsible in case of unauthorized use of the Account by a third party, and will not be responsible for any damage caused by such use.

If the Customer discovers that their Account is compromised or used without authorization, or any other security breach related to their Account, they must inform WIP Concept-Store as soon as possible. WIP Concept-Store will not be responsible if the Customer is unable to access their Account.

4.3. Security

The Customer undertakes not to act in the following ways, without this list being exhaustive:

•      Act in a manner that could compromise the operation of the Website;

•      Reproduce the Website, in any manner whatsoever, by any means and in any form;

•      Attempt to access a third party's Account;

•      Attempt to access the servers (excluding normal use of the Website) or computers on the WIP Concept-Store network;

•      Attempt to upload viruses, Trojans, or any other invasive or illegal program to WIP Concept-Store's servers;

•      Extract data or computer code from the Website without prior written authorization from WIP Concept-Store, including adapting, modifying, translating, transcribing, arranging, compiling, decompiling, assembling, disassembling, transcoding all or part of the Website;

•      Use the Website in an illegal manner or in violation of these GTC or any applicable law.

4.4. Links to third-party sites

The Website may contain links to third-party sites as well as articles, photographs, texts, graphics, images, design elements, music tracks, sound files, video sequences, information, applications, software and other content or elements belonging to or originating from third parties. Consequently:

•      The posting of links to a third-party site or content belonging to a third party is not subject to the control of WIP Concept-Store;

•      WIP Concept-Store does not guarantee the accuracy, relevance or completeness of third-party sites or content belonging to a third party;

•      WIP Concept-Store cannot be held responsible for the content, accuracy, offensive nature, opinions, reliability, privacy practices and other practices of third-party sites or content belonging to a third party;

•      Access to third-party sites or the use of content belonging to a third party is at the Customer's own risk.

WIP Concept-Store shall in no way be held liable for any direct or indirect damage that may be caused by third-party sites.

4.5. Account closure

In the event of a breach of the GTC by the Customer, or in the event of inactivity by the Customer for more than two (2) years (date of last login), WIP Concept-Store may close and delete the Customer's Account, at its discretion, without WIP Concept-Store's liability being engaged, without prior notice, and without any compensation being claimed by the Customer.

All sums owed to WIP Concept-Store by the Customer shall remain due. However, WIP Concept-Store may hold the Customer liable and claim damages in this respect, if the Customer has not complied with these GTC.

4.6. Account Data

The Customer undertakes to provide real and up-to-date information on their Account, as this information is used to process Orders. In accordance with the "Personal Data" Article and the Privacy Policy, the Customer may also request the deletion of their Account, and exercise their rights arising from the amended French Data Protection Act no. 78-17 of January 6, 1978 and the General Data Protection Regulation (EU Regulation 2016/679, known as "GDPR"). In this case, the Customer's data will be deleted by WIP Concept-Store, unless it is necessary for WIP Concept-Store to comply with its legal and regulatory obligations.

Article 5: Price

5.1. Price

The price of the Products indicated on the Website is provided in euros, including all taxes, including VAT and any other applicable taxes on the date of Order. The price of the Products will be detailed during each Order. Where applicable, shipping costs, as described on the Website, will be added.

For all Orders whose billing or delivery address is indicated outside the European Union and/or French overseas territories, the price is calculated excluding taxes during the Order. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases, and are borne by the Customer, who must declare and pay them to the competent authorities, under their own responsibility.

The Customer is responsible for keeping informed of the formalities and duties to be paid, and WIP Concept-Store will not be held liable in this regard. WIP Concept-Store is free to modify its prices at any time, but undertakes to apply the price validated by the Customer to all Orders.

The Customer bears the cost of accessing the Website (internet access, computer terminal). All payments are made net and without discount. Payment is due immediately upon Order.

5.2. Payment

The Customer can make their payment by credit card or by any other means offered by WIP Concept-Store. The Customer guarantees to WIP Concept-Store that they are the holder of the payment method used for the purpose of paying the Order and that they have sufficient funds to fully cover the payment of their Order. By providing their banking information during the sale, the Customer authorizes WIP Concept-Store to debit their card for the indicated price amount.

Unless otherwise specifically agreed by WIP Concept-Store, the Order will only be considered as constituted once payment has been received by WIP Concept-Store. In the event that, for any reason whatsoever (opposition, refusal by the issuing center, etc.), the debit of the sums due by the Customer proves impossible, the order will not be registered by WIP Concept-Store. Payment will be debited at the time of validation of the Order by the Customer.

In case of impossibility to debit the sums due for the payment of the Order, for any reason whatsoever, the Order will be canceled, without engaging the responsibility of WIP Concept-Store, and without prejudice to any damages that WIP Concept-Store may claim to compensate its loss.

Payments by credit card are made through secure transactions provided by a payment service provider acting in accordance with best practices. The payment service provider is Stripe, whose general terms and conditions are accessible at stripe.com. WIP Concept-Store has no access to any data relating to the Customer's payment methods except for the last digits of their credit card. Payment is made directly to the bank or payment service provider receiving the Customer's payment.

In case of payment difficulties or problems, the Customer can contact WIP Concept-Store at the following address: wipconceptstore@gmail.com.

Article 6: Order Steps

6.1. Order Process

Prior to their first Order on the Website, the Customer must create an Account. The Order follows the following steps:

•      The Customer visits the Website and chooses the Product after viewing its page;

•      The Customer chooses the options applicable to the Product they wish to Order;

•      The Customer adds the Product to their cart;

•      The Customer enters their Order information, and enters their payment information;

•      The Customer reads and accepts these GTC;

•      The Customer checks the Order summary, and if necessary, corrects any errors;

•      The Customer validates the Order.

The Customer will then receive confirmation by email of the payment of the Order, as well as an acknowledgement of receipt of the Order confirming it. They will receive a PDF copy of these GTC.

No Order is constituted unless WIP Concept-Store receives payment from the Customer. WIP Concept-Store will only send a confirmation of the Order upon receipt of payment. Otherwise, no Order is constituted. The Order is then sent in accordance with WIP Concept-Store's commitments.

6.2. Refusal of Order

In accordance with Article L.121-11 of the Consumer Code, WIP Concept-Store reserves the right to refuse any Order for legitimate reasons, particularly in case of payment problems, delivery problems due to incomplete and/or inaccurate information provided by the Customer, abnormally high Orders compared to those usually placed by the Customer or Orders placed in bad faith.

6.3. Order Error

WIP Concept-Store shall in no case be responsible for errors in product selection, product option, input errors made by the Customer during the Order, or any other information provided that proves to be erroneous, nor for their potential consequences, including delays or delivery errors. In this case, if WIP Concept-Store commercially agrees to reship, the costs incurred by any reshipment will be borne by the Customer.

6.4. Archiving

WIP Concept-Store will archive transactions made on the Website, and invoices on a reliable and durable medium constituting a faithful copy. The computerized records will be considered by the Parties as proof of communications, payments and transactions between the Parties.

Article 7: Products

7.1. Stock

WIP Concept-Store undertakes to fulfill the Customer's Order only within the limit of available Product stock.

Product stock levels are indicated on each Product page or prior to ordering. All Products are sold in limited quantities. By ordering the Product, the Customer accepts the deadlines indicated by WIP Concept-Store. For an Order of an in-stock Product, the minimum delivery time is seven (7) calendar days. All Products are limited editions, and often in small quantities.

The Customer is solely responsible for ensuring that the chosen Product option, if applicable, is the relevant option for their needs. In the event of unavailability of a Product for a period exceeding seven (7) working days, the Customer will be immediately notified of the foreseeable delivery times and the Product Order may be cancelled upon simple request to Customer Service. The Customer may then request a credit for the amount of the Product or a refund, which will be processed within fourteen (14) days.

7.2. Offers

WIP Concept-Store is free to offer temporary or permanent promotions on Products (discounts, promotional offers, etc.). WIP Concept-Store may end an offer on a Product at any time, which the Customer accepts. The validity period of Product offers and their prices are specified on the Website.

7.3. Legal Guarantees

The essential characteristics of the Products are detailed on each Product page on the Website.

Product photographs are provided for informational purposes only and are not contractually binding. They should not be considered by the Customer as a determining factor in consenting to place an Order. WIP Concept-Store cannot be held responsible if the delivered Products are not identical in all respects to those presented on the Website.

The Client is informed and accepts that the Products may be handcrafted, which will be specified on the Website, which may cause differences between the Product specifications and the Product as delivered. The Client is invited to read all information accompanying the Product or appearing on the Product or its packaging, in particular information related to any precautions for use, conditions and restrictions of use. The Client must ensure that the Products meet their expectations and needs prior to ordering. The Products are manufactured in compliance with the applicable community regulations.

Products marketed by WIP Concept-Store are subject to the legal guarantees of the Consumer Code and the Civil Code, and more particularly to articles L.217-3 et seq. of the Consumer Code (legal guarantee of conformity, as resulting from Ordinance n° 2021-1247 of September 29, 2021) and to articles 1641 to 1649 of the Civil Code (guarantee against hidden defects). A lack of conformity occurs when:

•      The good is unfit for the use ordinarily expected of a similar good;

•      The good does not match the description given by WIP Concept-Store;

•      The good does not possess the qualities advertised by WIP Concept-Store.

In the event of non-conformity of the Products or application of the guarantee against hidden defects, the Client must notify WIP Concept-Store of the Product defects, including a detailed explanation of the problem encountered. If the complaint falls within the scope of a lack of conformity or a hidden defect, WIP Concept-Store may then, at the Client's choice:

•      Either deliver a Product of equivalent quality and price, subject to available stock; or

•      Refund the price of the Ordered Product within thirty (30) calendar days following receipt of the Product by WIP Concept-Store. This refund will be made to the Client's bank account, the details of which will be provided by the Client to WIP Concept-Store.

The Client has a period of two (2) years from the delivery of the Product to implement the legal guarantee of conformity (article L.217-7 of the Consumer Code). The delivery costs of a new Product will be borne by WIP Concept-Store. In the event of implementation of the guarantee, the Client must contact customer service at the email address specified in these General Terms and Conditions of Sale. WIP Concept-Store will then inform the Client of the procedure to follow for the return, and if applicable, the refund of the Product.

Article 8: Risks and Ownership

Products remain the property of WIP Concept-Store until full payment of the Order by the Client. Risks on the Products are transferred from WIP Concept-Store to the Client upon physical delivery of the Order to the Client (article L.216-4 of the Consumer Code).

Article 9: Delivery

9.1. Delivery methods

Delivery methods will be indicated on the Website and confirmed by the Client when placing the Order.

9.2. Delivery costs

Delivery costs will be indicated to the Client before any payment and are charged in addition to the price indicated on the Website. A free shipping offer may sometimes be offered for certain Products, and will be indicated on the Website with its practical terms.

If the Order contains other Products not subject to this offer, delivery costs may be charged proportionally for the Products not subject to this offer, at the discretion of WIP Concept-Store. Any Order of more than one hundred and fifty (150) euros including all taxes will benefit from free shipping.

9.3. Delivery Location

The Website has no geographical delivery limitation; Orders can be shipped worldwide. Delivery costs vary depending on the delivery location, are listed on the Website, and are indicated to the Client before the Order. Delivery will be made to the location indicated by the Client when placing their Order, who must ensure that no error has been made in entering their delivery location. The Client undertakes to provide factual information to allow the delivery of the Order.

9.4. Customs

In the event of delivery of a Product outside the territory of the European Union and in the DOM-TOM, the Client declares themselves the importer of the Product and accepts that in such a case WIP Concept-Store may be materially unable to provide them with accurate information on the total amount of fees relating to customs duties and formalities or import taxes applicable in the country where the delivery of the Product is requested.

Any tax not indicated during the Order process may be charged to the Client by the country concerned, in accordance with applicable legislation.

9.5. Delivery Time

Except in cases of force majeure, WIP Concept-Store will make its best efforts to deliver the Products within the deadlines indicated when placing the Order. This deadline does not take into account the Order preparation time.

In the event of impossibility to meet this deadline due to the carrier, WIP Concept-Store cannot, however, be held responsible for the delay. WIP Concept-Store will make its best efforts to inform the Client of any delay. The Client will be notified by WIP Concept-Store of the shipping date by email.

When an Order contains several Products, these may have different delivery times: we have several storage locations (including Paris and the Showroom in Guadeloupe). Thus, if in the same order, the Client has selected available Products located in different storage locations, all Products will be shipped at the same time, however this may cause a longer delivery time depending on the location. The Client will be informed of this at the time of the Order. The Client is invited to place several different Orders if they wish to receive available Products faster.

It is the Client's responsibility to ensure that the Order can be received by themselves or anyone present at their delivery address. In the event of the Client's absence on the scheduled delivery date, and if the package is returned to WIP Concept-Store due to non-collection by the Client, WIP Concept-Store may ask the Client for payment of delivery costs if they wish the Order to be resent to them.

A delivery is presumed to have been made as soon as the carrier's control system registers the availability of the Order to the Client (delivery against signature).

9.6. Refusal of package

The Client or the person receiving the Order may refuse a package upon delivery if they notice an anomaly concerning the delivery (damage, missing Product compared to the delivery note, damaged package, broken Product...). Any anomaly must then imperatively be indicated on the delivery note, in the form of handwritten reservations, accompanied by the signature of the Client or the person receiving the Order.

To exercise their right of refusal, the Client or the person receiving the Order must open the damaged or defective package(s) in the presence of the carrier and have the damaged goods returned by them, or at the latest return the package within seven (7) calendar days from delivery. Failing to comply with these requirements, the Client will not be able to exercise their right of refusal, and WIP Concept-Store will not be obliged to grant the Client's request to exercise the right of refusal.

If the Client's package is returned to WIP Concept-Store by La Poste or by other postal service providers, WIP Concept-Store will contact the Client upon receipt of the returned package to ask them what to do with their Order.

If the Client mistakenly refused the package, they may request its reshipment by first paying the postal charges for the new shipment. Postal charges must be paid even for Orders for which shipping was free when the Order was placed.

9.7. Delivery error or exchange

In case of delivery error or exchange (if the right of withdrawal is applicable), any Product to be exchanged or reimbursed must be returned to WIP Concept-Store in its entirety and in perfect condition. Any defect resulting from clumsiness or mishandling by the Client cannot be attributed to WIP Concept-Store.

9.8. Delivery delay

Any delay in delivery compared to the scheduled date, and except in cases of force majeure, may result in the termination of the sale at the Client's initiative, in accordance with article L.216-6 of the Consumer Code, upon written request from them by registered letter with acknowledgment of receipt, doubled by an email to WIP Concept-Store's customer service, which enjoins WIP Concept-Store to deliver within fifteen (15) days.

The Client will then be reimbursed, at the latest within fourteen (14) days following the date on which the contract was terminated, for the totality of the sums paid. This clause is not intended to apply if the delivery delay is due to a case of force majeure.

9.9. Loss by the carrier

WIP Concept-Store cannot be held responsible for indirect or immaterial damages or prejudices caused to the Client, whatever the cause, related to the loss or damage of the shipment by the carrier, nor for the resulting financial consequences, direct or indirect.

Article 9 bis: Showroom Pickup (Click & Collect)

9 bis.1. Service availability

WIP Concept-Store informs its customers of the definitive closure of its physical Parisian store. Consequently, the in-store pickup service (Click & Collect) is now offered exclusively at our Showroom located in Guadeloupe, at the following address:

WIP Concept-Store Showroom – Lotissement EPI, rue Jules Vernes, Moudong Sud, Jarry, 97122 BAIE-MAHAULT, Guadeloupe

The pickup service is currently only available at this address. Any Order placed with the "Showroom Pickup" option must be collected exclusively from this location.

9 bis.2. Pickup procedures

Showroom pickup is entirely free of charge: no shipping costs are charged when the Client chooses this option during their Order.

The waiting period for the Order to be available at the Showroom is two (2) to four (4) working days from the payment validation, subject to the actual availability of the ordered Products.

The Client is invited to contact the Showroom at 07 66 21 33 31 to receive the precise geolocation of the pickup location and to arrange an appointment for the actual pickup of their Order. Pickup is by appointment only.

The Client is informed by email as soon as their Order is ready for pickup. They have a period of fourteen (14) calendar days from this notification to proceed with the pickup. After this period, and after an unanswered reminder, WIP Concept-Store reserves the right to put the Products back on sale and to reimburse the Client for the amount of their Order, subject to any deduction for management fees.

9 bis.3. Proof of identity required for pickup

Upon pickup, the Client may be asked to present a valid form of identification and the Order pickup confirmation email. If the Client authorizes a third party to pick up on their behalf, this third party must be in possession of a written power of attorney signed by the Client, a copy of the Client's identification, and their own identification.

9 bis.4. Transfer of risks

In accordance with Article L.216-4 of the Consumer Code, the transfer of risks to the Client occurs at the time of physical delivery of the Product(s) at the Showroom.

Article 10: Right of Withdrawal

In accordance with articles L.221-18 et seq. of the Consumer Code, the Client has a period of fourteen (14) clear days to exercise their right of withdrawal, without having to provide reasons or pay penalties, with the exception, if applicable, of return costs. For commercial reasons, WIP Concept-Store extends this period to thirty (30) calendar days. This period starts from the receipt of the Order by the Client or a third party designated by them (other than the carrier).

The right of withdrawal may be exercised by the Client by contacting WIP Concept-Store at wipconceptstore@gmail.com, by filling out the standard withdrawal form below or by providing the same information by any other explicit means:

In the event of exercising the right of withdrawal within the aforementioned period, only the price of the Product(s) purchased and standard shipping costs will be reimbursed; return costs remain the responsibility of the Client. It is the Client's responsibility to obtain proof of return, by sending the request by registered letter with acknowledgment of receipt, duplicated by an email to WIP Concept-Store's customer service.

Reimbursement will be made using the same payment method chosen by the Client for the initial transaction, unless the Client expressly agrees that WIP Concept-Store uses another payment method, and to the extent that the reimbursement does not incur costs for the Client. WIP Concept-Store also reserves the right to defer reimbursement until receipt of the Product or as long as the Client has not demonstrated that they have shipped the Product, if such a demonstration has not previously occurred.

By way of exception to the foregoing, and in application of article L.221-28 of the Consumer Code, the right of withdrawal does not apply in particular to the supply of Products manufactured according to the consumer's specifications or clearly personalized, as well as to the supply of Products which cannot be returned for reasons of hygiene or health protection and which have been unsealed after delivery.

WIP Concept-Store will inform the Client if the right of withdrawal cannot apply to an Ordered Product, prior to the Order. The Client will signify their agreement by ticking a box for this purpose.

Article 11: Return of Products

This Article applies to the return of Products in case of withdrawal or exercise of legal guarantees by the Client (conformity and/or hidden defects). No Product purchased on the Website can be returned at stands, fairs, or pop-up stores, unless expressly agreed by management.

Returns of Products must be made in their original and complete condition (packaging, accessories, instructions, labels, etc.) so that they can be remarketed as new. They must not have been used, damaged, soiled or washed by the Client. They must be returned complete, with their bags and/or bearing their label in appropriate packaging and accompanied by the return slip (to be filled in online and printed by logging into the Account). They should, if possible, be accompanied by a copy of the proof of purchase.

The transfer of risks will occur upon receipt of the Product by WIP Concept-Store, after verification of its condition and signature of the carrier's receipt. The Client must make the return using a solution that allows parcel tracking. Return costs are borne by the Client. Delivery costs charged when shipping the Order are not reimbursed (except for lack of conformity or hidden defect).

Products must be returned, at the Client's choice, to one of the following two addresses:

Before any return, the Client is invited to contact customer service at wipconceptstore@gmail.com or by phone at 07 66 21 33 31 to confirm the most appropriate return address and, if applicable, obtain a return number.

WIP Concept-Store cannot be held responsible for any loss or damage occurring during transport. In case of loss or damage during transport, the Client must contact their carrier directly. If the items are not received at the warehouse, WIP Concept-Store will not be able to process the return.

In the event of depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product(s), the Client's liability may be incurred.

The Client will be reimbursed for the price of the Product within fourteen (14) calendar days following receipt of the Product by WIP Concept-Store, or proof of shipment by the Client if earlier (Article L.221-24 of the Consumer Code). This reimbursement will be made using the same payment method as that used for the Order, unless the Client expressly agrees to another method.

Article 12: Complaints

If necessary, the Client may submit any complaint by contacting WIP Concept-Store at the following address: wipconceptstore@gmail.com or by phone at 07 66 21 33 31. They must provide their precise contact details and the reason for the complaint. WIP Concept-Store will respond as soon as possible.

Article 13: Intellectual Property Rights

Trademarks, domain names, products, software, images, videos, texts, or more generally any information subject to intellectual property rights appearing on the Site are and remain the exclusive property of WIP Concept-Store or its partners who have duly authorized WIP Concept-Store to use them. No transfer of intellectual property rights is made through these T&Cs.

Any total or partial reproduction, modification, or use of these assets for any reason whatsoever is strictly prohibited, and could constitute an act of counterfeiting, for which WIP Concept-Store could implement all means at its disposal to defend its rights.

Article 14: Liability

Only direct damages caused to the Client may engage the liability of WIP Concept-Store. No indirect damages may engage the liability of WIP Concept-Store. This limitation of liability concerns all types of indirect damages, including but not limited to, operating losses, loss of turnover, loss of orders, loss of profit, loss of data or other information, loss of clientele, loss of anticipated savings, damage to image and reputation, loss of opportunity.

WIP Concept-Store will also not be liable for damages caused by malicious software, viruses, or by any inaccuracy or omission of information, unless the damages result from a deliberate act or gross negligence on the part of WIP Concept-Store.

In all cases, and if the liability exclusions in this Article do not apply, the liability of WIP Concept-Store towards the Client for damages is strictly limited to the amount of the Order that caused the damage.

These limitations shall not apply to damages resulting from a breach of public policy legal obligations incumbent upon WIP Concept-Store, particularly regarding the legal guarantee of conformity and the guarantee against hidden defects.

Article 15: Force Majeure

The performance of WIP Concept-Store's obligations under these terms is suspended in the event of an unforeseen event or force majeure that prevents their execution. WIP Concept-Store will notify the Client of the occurrence of such an event as soon as possible.

For the purposes of these T&Cs, force majeure is understood as any unforeseeable, irresistible, and external event to the Parties within the meaning of French law and jurisprudence (Article 1218 of the Civil Code).

In the event of force majeure, WIP Concept-Store will make its best efforts to resume the performance of its obligations as soon as possible. If the force majeure persists, WIP Concept-Store may terminate its obligations towards the Client, reimburse them, without incurring its liability.

Article 16: Personal Data Protection

As part of the provision of the Site and the fulfillment of Orders, WIP Concept-Store may collect and process Personal Data, as a data controller within the meaning of the General Data Protection Regulation (EU Regulation 2016/679, known as "GDPR") and the Data Protection Act no. 78-17 of January 6, 1978, as amended.

This collection and processing are governed by the Privacy Policy, accessible at the following address: https://wipconceptstore.com/pages/politique-de-confidentialite-wip.

The Client has a right of access, rectification, erasure, limitation, portability, and opposition to the processing of their Personal Data, as well as the right to define directives concerning the fate of their Data after their death. These rights can be exercised by writing to: wipconceptstore@gmail.com. The Client also has the right to lodge a complaint with the French National Commission for Information Technology and Civil Liberties (CNIL), 3 place de Fontenoy – TSA 80715, 75334 PARIS CEDEX 07.

Article 17: Consumer Mediation

In accordance with the provisions of Articles L.612-1 et seq. of the Consumer Code, the Client has the option, in the event of a dispute with WIP Concept-Store and after a prior attempt at amicable resolution with customer service that remained unsuccessful within a period of one (1) month, to use the following mediation service free of charge:

The Client remains free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each Party is free to accept or refuse the solution proposed by the mediator.

Important information: the European Commission's Online Dispute Resolution (ODR) platform was officially closed on July 20, 2025. Therefore, no disputes can be submitted there anymore. Clients residing in the European Union are invited to contact the national mediator designated above.

Article 18: Applicable Law and Disputes

The T&Cs are governed by French law.

Any dispute relating to the execution or interpretation of these T&Cs, not resolved amicably between the Parties or through mediation, will be submitted to the competent French courts according to the rules of common law. In accordance with Article R.631-3 of the Consumer Code, the consumer Client may, at their choice, bring an action before one of the territorially competent courts under the Code of Civil Procedure, or the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the damaging event.

Article 19: General Provisions

19.1. Compliance with legislation

WIP Concept-Store provides the Site and supplies the Products in compliance with current French and European regulations. The Client must familiarize themselves with local and national laws to ensure they can use the Site.

19.2. Entire agreement

These T&Cs prevail over any other stipulation potentially applicable to the relationship between WIP Concept-Store and the Client. These T&Cs cancel and replace any prior commitment of the Parties relating to the subject matter and constitute the entire agreement between the Parties with regard to the subject matter hereof.

19.3. Exclusivity

No exclusivity is concluded between the Parties by the acceptance of these T&Cs. The Parties remain free to contract with third parties of their choice.

19.4. Survival of certain stipulations

The termination of these T&Cs, for whatever reason, shall not constitute termination for clauses whose nature or content requires their continuation.

19.5. Partial invalidity

If one or more stipulations of these T&Cs are held to be invalid or declared as such pursuant to a law, regulation, or following a final decision of a competent court, they shall be deemed unwritten and the other stipulations shall retain their full force and scope.

19.6. Non-waiver and tolerance

The fact that WIP Concept-Store does not invoke a breach by the Client of any of the obligations referred to in these T&Cs shall not be interpreted in the future as a waiver of the obligation in question and does not have the effect of granting the Client acquired rights. A failure or delay in exercising a right by WIP Concept-Store cannot be interpreted as a waiver of that right.

19.7. Independence

Neither Party may make a commitment on behalf of and/or for the account of the other. In addition, each Party remains solely responsible for its actions, allegations, commitments, services, products, and personnel.

19.8. Proof

The Parties accept that all electronic communications, particularly emails, constitute proof between them. The Client specifically acknowledges the evidentiary value of WIP Concept-Store's automatic recording systems, and, unless they provide proof to the contrary, they waive the right to dispute them in the event of a dispute.
